General Terms and Conditions

§1 Scope of application

These customer information and General Terms and Conditions shall apply to all orders placed through the website www.kristalos.com (the "Website") of Kristalos. Placing an order with us indicates your acceptance of these terms and conditions.

Changes to these General Terms and Conditions will only be effective if they are confirmed by us in writing. This also applies to any change to this written form clause.

§2 Parties to the purchase agreement

This Website for the sale of goods via the Internet is operated by Kristalos, Sollner Strasse 16, D-81479 Munich, Germany, which is legally represented by Alexandros Thomaidis as Owner. This is where you can place complaints or assert warranty claims.

§3 Conclusion of a purchase agreement

Any orders from you on our Website constitute a binding offer to conclude a purchase agreement with Kristalos. The binding purchase agreement only comes into existence when we accept your order either on the website or by sending you an e-mail or written communication or by dispatching the goods ordered.

The goods and price information on our Website is subject to change without notice. You will be charged the price displayed on the Website at the time of your order.

In case that you don´t have an order confirmation within two (2) weeks or a delivery service, you are not bound to your order anymore.

§4 Reservation of performance in case of goods not being available

If goods you ordered are not available within 30 days of your order we can withdraw from the purchase agreement even if we have confirmed acceptance of your order. If we withdraw from the purchase agreement we will immediately inform you of this and will immediately refund the consideration already paid by you for these goods.

§5 Minimum Order Value

For Private Customers:
For orders in Germany, there is no minimum order value.
For orders outside Germany there is a minimum order value of EUR 50,00.

For Business Customers:
For Orders in Germany or outside Germany, there is a minimum order value of EUR 500,00.

§6 Price and additional costs

The total amount of your order, including all taxes and costs such as packaging and delivery is displayed on the previous screen or at the end of the check out process.

§7 Terms of payment

I. The purchase price for the goods ordered becomes due upon the shipping of your order by Kristalos Online. Depending on the country we offer a different way of payment.

For Germany, we offer three (3) ways of payment

a. Prepayment (bank transfer)
b. Invoice (only for registered users in Germany and Austria).
c. Credit Card (Visa Card, Visa Electron, EuroCard / MasterCard, American Express)

For other countries except Germany, we offer two (2) ways of payment

a. Prepayment (bank transfer)
b. Credit Card (Visa Card, Visa Electron, EuroCard / MasterCard, American Express)

II. In proof of delivery you will recieve your invoice. This is within 7 days due for payment (only for Germany and Austria).

§8 Delivery and reservation of title

The goods will be delivered to the delivery address as stated by you and through a delivery service (UPS or DHL) appointed by us. We will make every effort to deliver the goods on the date you requested, but we cannot make a binding statement on this. The goods remain our property until we have received payment in full.

§9 Right to cancel the purchase agreement

As a consumer you have the right to cancel this purchase agreement up until two weeks after receipt of the goods by you. No reason needs to be stated. If you exercise this right of withdrawal you are no longer bound to the agreement and we will refund any payments you have made in respect to this agreement.

If you cancel the purchase agreement you have to send back the goods within 30 days after the cancellation. The goods returned are dispatched at the risk of Kristalos, but you must pay the direct costs of returning the goods and take reasonable care of the goods until they are dispatched.

§10 Warranty

The warranty period is two years after receipt of the goods by you. Should the delivered goods prove defective within this period, you may cancel the agreement or - if the product is still available - request their replacement by giving us notice at the address specified in paragraph 2. No independent guarantee is granted beyond the foregoing.

Kristalos is not liable for damages, unless damages have been caused by intent or by gross negligence. In no event Kristalos shall be liable for indirect damages.

The exclusion or the limitation of the liability for damages according to the above paragraphs also applies to potential claims against employees or authorised representatives of Kristalos.

§11 Data Protection

We will process your personal date fairly and lawfully. The processing will be carried out with electronic and automated means. We will use your personal date only for market research to improve our website and our product range, and to keep you informed about about market activities.

§12 Copyright (law)

§13 Prohibition of assignment

You may assign your contractual rights to a third party only with Kristalos prior written consent.

§14 Applicable law

The agreements concluded under the inclusion of these General Terms and Conditions are subject to the law of Germany also for foreigner purchasers. The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.
